Practice Areas

Our firm’s practice is concentrated in the area of law often referred to as “civil litigation.” Civil litigation is a process through which individuals or businesses either resolve disputes or present the disputes to the courts for trial. Though many cases are resolved prior to trial, we stand ready to take our client’s case to trial. This approach greatly benefits our clients by strengthening our negotiating position to achieve a swift and beneficial resolution.

Personal injury lawsuits are brought to compensate those harmed by the negligence, recklessness, willful misconduct, or inaction of others. Our clients include people who have been injured or the family members of those killed through the fault of another person or entity. This field of law, also known as “tort” law, encompasses a wide range of legal claims in which victims may seek recovery for physical and emotional injuries, property damage, and even death of the victim. Compensation is sought for medical expenses, loss of income, mental and physical pain and suffering, and temporary and permanent disability. Personal injury cases include:

  • Automobile accidents
  • Construction accidents
  • Defective products or products liability
  • Premises liability or slip and falls
  • Professional negligence

Through preparation, integrity, and diligent representation of our clients, Nash Law Firm has built a excellent reputation. We help clients deal with every aspect of the legal process based on decades of experience.

We also represent individuals and business in commercial disputes.

Commercial litigation comes in all shapes and sizes. We recognize that the needs of every company are very different, and we evaluate your case early in the representation to achieve an early and successful resolution at a reasonable cost so that you can focus on running your business. Commercial cases include:

  • Breach of contract claims
  • Business torts
  • Fraud claims
  • Class action lawsuits

In addition to assisting clients after a dispute has arisen, we represent small businesses on an ongoing basis with the purpose of helping them avoid litigation. Litigation is sometimes unavoidable, but often times an attorney can recognize a potential problem and solve it before it becomes a lawsuit. We help clients with business plans, corporate or limited liability company formation, shareholder agreements, and other contracts and transactions that arise in the running of a company. We can educate owners and their staff on ways to avoid the legal system so that they can focus on growing and running a successful enterprise.

Products liability is an area of law that provides for compensation for physical injuries and property damage resulting from defective and unreasonably dangerous products and from the failure of a manufacturer or seller to warn the consumer of product dangers.

A products liability claim includes many claims for personal injury, death or property damage caused by the manufacture, construction, design, formula, preparation, assembly, installation, testing, warnings, instructions, marketing, packaging or labeling of any product.  It includes cases for:

  • Defective products
  • Failure to provide proper warnings or instruction for use of inherently dangerous products

Many of the cases which we handle involve some aspect of the ownership of real property or real estate. Included in property cases are:

  • Contract disputes for the purchase and sale of property
  • Claims for defective construction or maintenance involving a builder or developer
  • Condemnation of property by governmental authority for public projects

In addition to preparing Wills and Powers of Attorney, and handling the normal administration of estates, we also represent clients in disputes over the settlement of estates following the death of a family member. These very sensitive and emotional cases involve contesting wills, transfer of property  between deceased and a family member prior to death, conflicting claims as to certain assets, or actions for accounting and settlement of funds managed by one family member. The firm makes every effort to handle these cases in a way that seeks justice for our clients and reconciliation among family members, if at all possible. These may involve:

  • Will contests
  • Improper transfer of property by an elderly or disabled person
  • Wrongful use of Power of Attorney

Mediation is a process by which many contested matters may be resolved through the process of negotiation facilitated by a trained neutral professional, known as a mediator.  The process of mediation is either court-ordered or entered into voluntarily by the parties.  It allows the parties to resolve matters between themselves without further intervention by a court or jury, reducing costs of litigation, and allowing the parties to control the resolution of the dispute.  Mr. Nash is certified as a mediator for general civil matters by the Georgia Office of Dispute Resolution.

Because of our years of experience in many areas of the law, we are able to provide virtually full service to our clients. We pledge, however, that if you consult us regarding an area that does not fall within our abilities or expertise, we will refer you to an attorney who is qualified and competent to serve your needs in that area of the law.
